INTENT:- When both parties enter into this agreement, it is the intent of both the Booker and the Artiste to enter into this agreement as a contract.

SAFETY:- It is the responsibility of the Booker to take all reasonable steps to provide a safe venue for the performance and a safe supply of electricity. The Booker is to ensure that all current Health and Safety guidelines are followed. Open-Air or Marquee venues must be agreed in advance.

PAYMENT:- A Deposit of 25% is normally required to secure all bookings. The deposit is by cheque made payable to Richard Appleby. The balance of the fee is payable in cash on the evening of performance, strictly prior to the performance. Balance Payments by cheque should be received not less than 21 days prior to the Booking.

CANCELLATION:- Your deposit secures your booking. If a booking is cancelled by you within 21 days of the function date, a cancellation fee of 50% of the agreed performance fee is payable. The full agreed fee is payable if the booking is cancelled with 72 hours of the performance.

CHANGES:- The terms of any agreement or contract may not be modified or cancelled unless agreed by both parties and confirmed in writing.

FACILITIES:- Reasonable facilities shall be provided by the Booker for the Artiste including necessary tables, chairs and changing facilities.

INTERVALS:- Playing times and intervals to be agreed by both parties before the start of the performance, up to a maximum as stated by the Contract - Schedule.

VOLUME:- The volume of the Artiste’s amplification is to be kept to the requirements of the Booker within the capabilities of the equipment.

LIGHTING EFFECTS:- Should any audience members suffer from epilepsy, the use of Xenon-based lighting can be discontinued. Please discuss your requirements with the Artiste.

LIGHTING EFFECTS 2:- The Booker is responsible to ensure that the venue is prepared for any optional extras or special effects used by the Artiste. Haze and smoke machines require low sensitivity smoke detectors, or isolated smoke detector circuits for the function room. Other Lighting and PA require no specific preparation. We are unable to offer refunds if special effects cannot be used due to the environment.

PHOTOGRAPHS:- The Booker agrees to allow the Artiste to take Photographs during the Performance, which may be used for publicity or promotion purposes. Copies available on request.

NON-FULFILMENT:- Every reasonable safeguard will be made to ensure that non-fulfilment is avoided. If both parties are in agreement under contract by signing a contract confirmation form, then fulfilment is assured.

ACCESS:- Reasonable access to the Venue for the Artist is to be ensured by the Booker. Difficult access routes to the performance area must be approved prior to the performance. We normally need un-interrupted access to the performance area at least 1.5 hours before the performance.

DAMAGES:- Should any damage occur to the Artiste's person, property or equipment, caused by the Booker, their guests, or other function staff, the Booker is to ensure full responsibility, both legally and financially, including but not limited to the cost of replacement equipment, hire of interim replacement equipment, transport costs, medical expenses, legal costs, et al.

ACCEPTANCE:- It is agreed by both parties that by accepting this agreement and contract, all conditions of service as printed above are also accepted.
